Wines, District Judge:

This is a motion to quash and set aside a writ of certiorari which is before this court on these facts.

On November 9, 1948, the petitioners here, as plaintiffs, filed a complaint in the Second judicial district court of the State of Nevada, in and for the county of Washoe, in department 2 thereof, naming the United States Gypsum Company and the Pacific Portland Cement Company as defendants.
