Plaintiff appeals from the judgment and from an order denying his motion for a new trial in his action for damages for personal injuries. Defendant’s motion for nonsuit was granted, and we are called upon to determine whether or not the court erred in its action on said motion. The evidence in plaintiff’s behalf showed that at the time of the injury he was walking between the tracks of the defendant corporation on Santa Monica Avenue in the county of Los Angeles.
