The United States appeals the district court’s decision to dismiss an indictment charging Defendant-Appellee Benjamin Raymond with several violent crimes allegedly undertaken as part of his membership in the Aryan Brotherhood. The district court dismissed the indictment after finding that an earlier plea agreement between Raymond and the United States precluded the United States Attorney’s Office for the District of New Mexico from pursuing these charges.
