MEMORANDUM OPINION

This matter is before the Court on the Defendant’s Motion to Dismiss (Docket No. 148). For the reasons that follow, the motion will be denied.

BACKGROUND

On January 8, 2008, Gary Wayne Turner (“Turner”) and Michele Lynn Zechman (“Zechman”) burglarized a home in Campbell County, Virginia, and stole eleven firearms.
