BRECKENRIDGE, Judge.

James Karr appeals from his conviction of driving while intoxicated as a prior offender, a class A misdemeanor under § 577.010, RSMo 1994.1 Mr. Karr was also charged with five counts of second degree assault in violation of § 565.060 but was acquitted of those charges. Mr. Karr raises two points on appeal. First, he contends that the trial court erred by refusing to submit his proposed instruction on the defense of justification because Mr. Karr drove while intoxicated in order to prevent a significant harm, there was no adequate alternative to this course of action and…
