Boone County Retirement Center, Inc. (BRC) and Patrick D. Rackers (Rackers) appeal their convictions, respectively, of two counts each of the class D felony of neglect of a nursing home resident pursuant to § 198.070.il. 2 BRC is a not-for- profit corporation operating a nursing home in Boone County, Missouri, and Rackers was, at all relevant times, the administrator of the nursing home. BRC admitted both private pay and Medicaid residents.
