Plaintiffs in error will be designated as defendants and defendant in error as plaintiff, in accord with their respective titles in the trial court. On April 12, 1912, plaintiff commenced this action upon a promissory note and to foreclose a real estate mortgage as security therefor upon lots 24, 25, 26, 27, and 28 in the original town of Frederick, Okla., and obtained service’ of summons upon defendants by publication predicated upon an affidavit therefor in the part in question here as follows:
