C. G. Henderson and others, as- the only surviving children of Mrs. Frances Prior Henderson (née Howard), brought suit against A. H. Howard to recover 200 acres of land, claiming title. The case was submitted to Judge Park, for decision without the intervention of a jurjr, upon the petition and answer and the following agreed statement of facts: The plaintiffs are the only surviving children of Frances Prior Henderson (née Howard) and Isaac W.
