MEMORANDUM ON STATUS OF LEASE/SECURITY AGREEMENT

The matter before the Court was prompted by a Motion to Compel Debtor to Accept or Reject an Executory Contract filed by Reservoir Leasing Corporation regarding the telephone system allegedly leased to the debtor. The trustee, in response to the motion, denied the validity of a lease, claiming that the equipment was properly vested in the debtor, and that any claim of Reservoir Leasing (“Reservoir”) should be equitably subordinated under 11 U.S.C. § 510(c)(1).
