This is a motion by plaintiff for summary judgment against defendants Wallabout Butter & Egg Co., Inc., and Zurich *70General Accident & Liability Insurance Company, Limited. The motion purports to be based upon subdivisions 1, 6 and 7 of rule 113 of the Rules of Civil Practice.
