BECKER, Circuit Judge.

This appeal presents the question of the constitutionality, under the due process and equal protection clauses of the Pennsylvania and United States Constitutions, of Pennsylvania Rule of Civil Procedure 238, 42 Pa. Cons.Stat.Ann. Rule 238 (Purdon Supp.1990). Rule 238 mandates the payment of delay damages by defendants to plaintiffs in tort cases under certain circumstances.
