This action was commenced in the court below by the Great Bend Oil Company, a corporation, as plaintiff, against W. A. Jarvis, N. A. Weems, and H. C. Becker, as defendants, to recover secret profits alleged to have been obtained toy defendants as promoters of the plaintiff corporation through fraud practiced upon it by means of false representations to the other subscribers to its capital stock, inducing the purchase of an oil and gas lease with the corporate funds paid in by such subscribers at a price far in excess of its value; such excess, unknown to the other…
