This action involves the granting of an injunction pendente lite. The complaint alleges the corporate existence of respondent and sets forth at length facts relating to its acquisition of certain lands and water rights in and around Post Falls in 1902 and 1903. It is further alleged that in 1905 and 1906 respondent continued the development of water power theretofore commenced by its predecessor, and constructed dams and other improvements and since said time has been developing electrical energy for the lighting of cities and towns and other beneficial uses; that respondent is a public…
