Appeal from a judgment of the County Court of Ulster County (Bruhn, J.), rendered June 26, 2007, upon a verdict convicting defendant of the crimes of rape in the first degree and rape in the third degree.
*1288In the wake of allegations that defendant had raped a woman, he was interviewed by investigators and stated that he had engaged in sex with the victim, although he maintained that such was consensual.
