Victor A. Trotter, on February 20, 1933, secured from the defendant a life insurance policy for $100 and died on August 4, 1933. An action in assumpsit was brought by David J. Phillips, assignee of the beneficiary, to recover the face of the policy. The defendant paid one-half of the policy and defended as to the balance, when the case was called for trial by a judge of the municipal court sitting without a jury.
