Bill in equity brought by trustee in bankruptcy to recover of defendant certain moneys and property alleged to have been obtained by defendant for his benefit from an insolvent corporation of which said defendant was a director. Cause was heard before a single Justice and from his ruling an appeal was entered to Law Court. Decree in accordance with opinion. Case stated in opinion.

Bill in equity wherein the plaintiff, as trustee in bankruptcy of the National Boat and Engine Company, seeks to recover of the defendant the amount of certain payments, and the value of certain bonds, alleged to have been' obtained by him for his benefit from the corporation while he was a director thereof, and when it was insolvent. The ground for recovery is alleged to be, that the obtaining and acceptance of said payments and bonds by said defendant or for his benefit were in violation of his fiduciary duty as a director of said bankrupt corporation and in fraud of the rights of its…
