At the general election held on the eighth day of November, 1910, Sheridan S. Kendall, the respondent below, and plaintiff in error here, was elected to the office of railroad commissioner for a term of six years, beginning on the second Tuesday in January, 1911, under the provisions of an act entitled “An act to regulate common carriers,” etc., approved March 22, 1907. In section eleven of that act there was created a state railroad cominission, composed of three commissioners. The section provided, that the governor, by and with the consent of the senate, should appoint three commissioners…
