Action by appellants, in the lower court, to' obtain the cancellation of a certain -note and a mortgage, upon the alleged grounds that the same were executed without consideration, and that the possession of the instruments in question was obtained wrongfully by the appellee and without the consent of the appellants. The former answered the complaint by a denial, and also by way of a cross-complaint, whereby he sought to have the mortgage mentioned in the complaint foreclosed.
