The single question presented in this record is, whether the verdict is in accordance with the evidence. Counsel have discussed the rulings of the court in admitting-evidence, and in giving and refusing instructions, but exceptions to these rulings have not been saved. The trial was. had, and the motion for a new trial was filed, at the September-term, 1878, but no exception was then saved, nor time allowed for filing a bill of exceptions. At the ensuing October-term of the court, upon overruling the motion for a new trial, the court gave the appellant time for filing a bill of exceptions,…
