THIS MATTER is before the Court on Plaintiff Lawrence Gonzales’s Motion for Summary Judgment (ECF No. 13), and Defendant Truck Drivers and Helpers Local 355 Retirement Pension Fund’s (the “Fund”) Cross-Motion for Summary Judgment (ECF No. 14).
