The act of January 6, 1848, McClellan’s Digest, 439-40, provides that any person convicted of a criminal offence and sentenced to pay a fine, shall have the right, on being taken into custody by the proper officer of the court, or prior to such arrest, to give bail or security for the payment of such fine and the costs of prosecution adjudged against him.
