Harley Ray Olsen, a minor, by his guardian ad litem, sued Dr. Wayne McAtee, an osteopathic physician and surgeon, to recover damages for pain and suffering and time lost from school caused by the defendant’s alleged malpractice in the treatment of a fracture of the left femur suffered by the plaintiff. His parents brought a similar action to recover the amount of medical, hospital and other expenses incurred, and damages for the lost earnings of their minor child, as the result of the defendant’s alleged negligence.
