I. Background
The background of this case is detailed in our previous opinion, reported at Tri-State Generation & Transmission Association, Inc. v. Shoshone River Power, Inc., 805 F.2d 351 (10th Cir.1986) [hereinafter Shoshone 7], which considered Tri-State Generation and Transmission Association, Inc.’s (Tri-State’s) appeal from the district court’s dissolution of the preliminary injunction in this case.
