Defendant in error, who was plaintiff below, filed his petition in the district court of Kay county alleging that the city of Blackwell, a municipality of more than 2,000 population, owned, maintained, and operated an airport with hangar and storage facilities for storing, for hire, airplanes; that in so doing, said city of Blackwell did not act. in a governmental capacity, but operated said airport and carried on said business for the private advantage of the inhabitants of the city of Blackwell.
