— In an action, inter alia, to recover damages for fraud, defendant appeals from so much of an order of the Supreme Court, Nassau County, dated April 18, 1975, as denied so much of its motion as sought dismissal of the first and second causes of action asserted in the complaint. Order reversed insofar as appealed from, on the law, with $50 costs and disbursements, and so much of defendant’s motion as sought dismissal of the first and second causes of action granted.
