Appellant Kenneth Adler, D.O., an osteopathic physician, was convicted after a jury trial in federal district court 1 of fourteen counts of willfully and knowingly making false statements on claims submitted under the medicaid and medicare programs in violation of 18 U.S.C. § 1001, 2 and four counts of willfully and knowingly making false claims under the same in violation of 18 U.S.C. § 287. 3 Appellant now challenges his conviction on numerous grounds, including failure of the indictment to charge an offense, failure of the government to introduce sufficient…
