—This was an action by appellant, as ' devisee, and cestui que trust, under tbe will of Benjamin Harrison, deceased, grandfather of appellant, *247against appellee Russell B. Harrison, trustee, under the will of said deceased and as guardian of William Henry Harrison, and his codefendant, the Union Trust Company of Indianapolis, trustee by appointment of the superior court of Marion county, Indiana, under the will of said deceased, to recover the possession of a trust fund now in the hands of said Union Trust Company.
