In the year 1889, pursuant to the provisions of Bp. Laws 1889, ch. 205, bonds of the city of Crookston were executed and delivered to certain commissioners named in said act (who are defendants in this action) to aid in the construction of a line of railroad from a point on the line of the Duluth & Manitoba Bailroad into the city of Crookston. This action was prosecuted to restrain the commissioners from delivering the bonds to the defendant railroad company, on the ground that the conditions upon which such bonds were to be delivered had not been complied with.
