This action is brought to restrain the authorities of the city of Red Wing from issuing, and the appellant from receiving certain bonds of said city. The appellant claims that it is entitled to the bonds (in amount $85,000,) under an agreement and ordinance of said city, entered into and adopted in pursuance of an act of the legislature authorizing the same to be issued in aid of the construction of appellant’s railway.
