This is an appeal of a judgment rendered on issues decided by a jury. Appel-lee initially filed his lawsuit under provisions of the Deceptive Trade Practices And Consumer Protection Act [DTPA]. See Tex. Bus. & Com. Code Ann. §§ 17.41-17.63 (Vernon 1987 & Supp. 1999). The facts and circumstances revolved around the purchase of a boat by appellee [Boat 1], subsequent problems with said boat, replacement of the boat with a second boat [Boat 2] by appellant, and problems with the second boat.
