PARKER, Circuit Judge.

This is an appeal in a suit instituted in the United States District Court for the Northern District of West Virginia to enjoin violation of Maximum Rent Regulation No. 53, issued pursuant to the Emergency Price Control Act of 1942, 56 Stat. 23, 50 U.S.C.A.Appendix § 901 et seq., and the prosecution of eviction proceedings alleged to be in violation of the act. The plaintiff is the Administrator of the Office of Price Administration and the defendants are Rosa M.
