These appeals center on a “mere happening” jury instruction— an instruction asserting that the mere happening of an accident is, by itself, an insufficient basis for liability — given by the district court in a medical malpractice action. Initially, we must determine whether appellants preserved for our review their objection to respondent’s proposed jury instruction.
