Appellant has been convicted in the Warren Circuit Court of the crime of manslaughter under an indictment charging him with the murder of his brother, Robert Vontrees, and sentenced to the penitentiary for ten years. He has appealed, asking a reversal of the judgment upon the grounds that (1) the verdict of the jury is flagrantly against both the law and the evidence; (2) misconduct of the Commonwealth’s attorney during the trial and in his closing argument to the jury; and (3) the trial court should have sustained his motion to peremptorily…
