HELLENTHAL, District Judge.

The plaintiff, R. A. Francis, brought this action' to-quiet title to certain mining claims situate in the Talkeetna Recording Precinct, Alaska, under sec. 4001, C.L.A.1933,. and for damages for gold mined and taken from said claims, by the defendant, F. W. Jenkins.

It is alleged in the complaint that the plaintiff is the owner of and entitled to the possession of certain mining claims which the evidence shows were located by the persons and on dates as follows: Wolverine Fraction, located by the plaintiff and Clarence Sullens, April 14, 1933; Wolverine Pup, located…
