I think there can be no recovery in this case against the town; and as the question is one of much general importance, I shall be pardoned, I hope, for stating my reasons at considerable length. The provisions of statute material to be considered are sections one, two, six, seven and eight of chapter 160, Private Laws of 1854, and sections forty-one, sixty-six and seventy-four of chapter 15 of the Bevised Statutes.
