This action was brought by the appellee upon a promissory note of the following tenor, the italicised words being the written part of the note:

“ Lexington, Scott Co., Ind., Oct. 22d, 1869.

*' Nine months after date I promise to pay Miles & Spaulding, or bearer, two hundred and eighty-seven & 50-100 dollars, *228payable at the First National Bank of Madison, for value received, with interest, without relief from valuation or appraisement laws, interest at io per cent, per annum after maturity, and attorney’s fees if suit be instituted.
