OPINION

SMITH, Chief Judge.

This case comes before the court on the parties’ cross motions for summary judgment under RUSCC 56.1 This opinion follows a related decision issued by the United States District Court for the Western.District' of Washington, which awarded plaintiff damages for diminution in the value of her property caused by the negligent disposal of chemicals at an airbase adjacent to plaintiff’s property.
