This is an appeal on questions of law, from a judgment of the Court of Common Pleas, Franklin County, Ohio, rendered October 9, 1970, and entry overruling a motion for new trial filed October 22,1970.

The facts are that on or about September 4, 1968, ap- pellee and Ms wife discussed buying a yellow Opel station wagon with Thomas King, a salesman for appellant. Subsequently, King showed appellee and his wife a used 1968 Opel two-door sedan, which they purchased on October 6, 1968, for $1780.
