This was an action brought by appellees on a policy of insurance, in which certain property, located at Petoskey, Michigan, was insured against loss from fire. P. A. Montgomery & Co. were the general agents of the insurance company at Chicago, and in May, 1889, C. M. Fay, a member of plaintiffs’ firm, applied to P. A. Montgomery & Co., at their office in Chicago, for insurance on their Michigan property.
