On January 7, 1958 James P. Mitchell, Secretary of Labor, brought suit (Civil Action No. 10265) pursuant to the provisions of the Fair Labor Standards Act of 1938, as amended, 29 U.S.C.A. § 201 et seq., to recover on behalf of certain employees of the defendants unpaid minimum wages and unpaid overtime compensation allegedly due.
