OPINION AND ORDER
MUKASEY, District Judge.
Plaintiff Terje Nilsen, a resident of Monaco, charges that defendant Prudential-Bache Securities, Inc., a “futures commission merchant,” lied about and then “churned” his commodity option trading account, and thereby committed fraud in violation of sections 4b and 4o of the Commodity Exchange Act, as amended (“CEA”), 7 U.S.C. §§ 6b, 6o (1990). Nilsen has also brought state law claims for negligence and breach of contract.
