MEMORANDUM AND ORDER

LUNGSTRUM, District Judge.

This matter is presently before the court on defendants’ motion to dismiss plaintiffs third amended complaint (doc. 30). Specifically, defendants move to dismiss with prejudice plaintiffs complaint for failure to comply with the pleading requirements of Rules 8(a) and 9(b) of the Federal Rules of Civil Procedure. For the reasons set forth below, defendants’ motion is granted in part and denied in part.
