Action in the district court for St. Louis county to recover $1,999.90-damages for personal injuries. The case was tried before Dibell, J.„ and a jury which returned a verdict in favor of plaintiff for the sum demanded. From an order denying its motion for judgment notwithstanding the verdict or for a new trial, defendant appealed.

The principal question in this case is whether appellant company is chargeable with negligence in directing respondent to repair certain timbering in a drift in appellant’s mine, assuring him that the place-was safe to approach for that purpose.
Respondent and another were employed in mining ore by contract,, and had been driving a drift into the ore body and taking out the-ore as they went along.
