The, appeal in this case is from a judgment of the Superior Court of Baltimore City in an action of assumpsit on a building contract. The declaration contains the common counts together with a special one on the contract. The case was tried, on an issue joined on the general issue pleas, before a jury which, rendered a verdict for the plaintiff. From the judgment entered on that verdict the appeal was taken.
