Defendant-appellant, Douglas David Hock, was convicted after a jury trial of two counts of possession with intent to distribute methamphetamine in violation of 21 U.S.C. § 841(a)(1) and one count of using a firearm in relation to a drug trafficking offense in violation of 18 U.S.C. § 924(c)(1). After the Supreme Court’s decision in Bailey v. United States, 516 U.S. 137, 116 S.Ct. 501, 133 L.Ed.2d 472 (1995), the parties filed a joint stipulation asking the court to vacate Hock’s § 924(c)(1) conviction.
