MEMORANDUM AND ORDER

HUYETT, District Judge.

Plaintiff Wheelabrator Frackville Energy Company, Inc. (“plaintiff”) commenced this civil action against defendants 1 based upon diversity of citizenship. See Plaintiffs Complaint at 11 5. Specifically, plaintiff alleges that it is a citizen of Delaware and New Hampshire and all defendants are citizens of Pennsylvania. Id. at ¶¶ 1-4. Defendants moved to dismiss plaintiff’s complaint for lack of subject matter jurisdiction alleging that plaintiffs principal place of business is Pennsylvania instead of New Hampshire.
