— This action against the defendant is for a nonfeasance as a deputy sheriff, in not attaching sufficient property as ordered on mesne process in favor of the plaintiff, and against John Lane and Jabez Leadbetter, to satisfy the judgment afterwards recovered thereon. The writ was served, in 1829. This action was commenced in June, i 840; and within six years of the rendition of the judgment in that case. The statute of limitations is relied opon in defence.
