Action for damages from flooding plaintiffs’ building in May 1943, claimed to. have been caused by defendant’s dam, built across the Osage River valley at Bagnell in 1931, creating the Lake of the Ozarks. Plaintiffs obtained judgment for $600.00 and defendant appealed to the Kansas City Court of Appeals which affirmed the judgment. [Kennedy v. Union Electric Co., 203 S. W. (2d) 489.] The case was transferred here by the Court of Appeals “because of the general interest in, and importance of, the issues involved.” We handed down an opinion herein during our January-1948 Session…
