The. accused was found guilty of three violations of the Uniform Code of Military Justice. The only one of impor*221tance in this decision is the conviction of malingering, arising out of a charge of shooting himself in the hand to avoid service. Accused was originally sentenced to a bad-conduct discharge, total forfeitures, and confinement for three years. The convening authority, however, reduced the confinement to one year, and a board of review, after setting aside the findings of guilty on the malingering charge, approved only so much of the…
