This is an action instituted in the name of the Commonwealth of Kentucky, as plaintiff, in the circuit court of Harlan county, by the Commonwealth’s attorney for the 26th judicial district, in which that county is situated. The purpose of the action was to secure a for*105feiture of the title and claim of title held and claimed by the defendants, to 20,000 acres of land, part of which is situated in Harlan county and the remainder in Leslie county, by virtue of the provisions, of article 3, of chaptre 108 of Kentucky Statutes, and which includes sections…
